ZF-TRW Kia and Hyundai Recall

Carcomplaints.com reported that ZF TRW airbags would be the subject of a potential class-action lawsuit. The class-action suit, which is still in its infancy, alleges that 12.3 million vehicles, made by various automakers, were sold with defective airbag control units. Anyone who leased or bought various models of Acura, Dodge, Dodge Ram, Fiat, Jeep, Honda, Kia, Mitsubishi, Ram, and Toyota vehicles from approximately 2012 to 2019 could be a member of the class. The judge presiding over the case in U.S. District Court in Central California has not ruled in favor of the plaintiffs and certified the class at this time.

The seven plaintiffs who allege they could represent the class of plaintiffs in the case claim that ZF TRW and the auto manufacturers who sold vehicles with defective airbags are liable for damages to the plaintiffs. As part of the allegations, the plaintiffs said that they are stuck with vehicles that have lower trade-in value and have been exposed to unreasonable safety risks if the airbags did not deploy in an accident. The plaintiffs pleaded that the carmakers knew or should have known that the airbag control units were faulty. 

The potential class of plaintiffs argued that the defendant ZF TRW made defective application-specific integrated circuits. The circuits send signals from crash sensors placed about the car to fire the seatbelt pretension system within mere milliseconds during a crash event. The seatbelts hold the passengers in place and then release the occupant, who will then hit the airbag, at least in theory anyway. The defective airbag control units fail due to electrical over-stress from too many signals firing at once during a crash. The entire system could fail, and the occupant of the car, who was relying on the safety systems in the car for protection, is at the mercy of the physical forces imparted during a collision.
